Employee and Employer Contribution Division
The plan likely includes both employee deferrals (contributions from the participant’s paycheck) and employer contributions. Many plans also match employee deferrals up to a certain percentage. It’s essential that your QDRO specifies how both types of contributions should be divided.
For example, do you want to include only marital contributions—i.e., those made during the marriage—or total plan account value as of the division date? If not clearly addressed, this can delay or complicate the division.
