Employee Contributions vs. Employer Contributions
401(k) accounts typically include two sources of funds: employee deferrals and employer contributions. In most divorces, both are subject to division unless your agreement states otherwise. However, employer contributions may be subject to a vesting schedule. If your spouse is not fully vested, some of the account balance may not be available for division at the time of divorce. We recommend confirming the vesting status directly with the plan administrator early in the QDRO drafting process.
