Employee and Employer Contributions
In most 401(k) plans like this one, contributions from the employee are always 100% vested—meaning they belong to the employee immediately. Employer contributions, however, often follow a vesting schedule. Your QDRO must clarify whether the award includes only vested employer contributions or also unvested amounts.
