1. Employee vs. Employer Contributions
In most 401(k) plans, contributions come from both the employee and the employer. Each of these sources needs specific treatment in the QDRO:
- Employee Contributions: These are usually 100% vested and can be divided without restriction.
- Employer Contributions: These may be subject to a vesting schedule. If the employee isn’t fully vested, some of the employer match may not be available for division.
