Employee vs. Employer Contributions
In many 401(k) plans—especially those in the corporate sphere like Rh operations Inc. 401(k) plan—both the employee and employer make contributions. Your QDRO should specify whether the alternate payee will receive a portion of only the employee contributions, or if it includes vested employer matching contributions as well. If the couple was married through the full length of the plan participation, it’s usually fair to include both, but the language must be clear.
