Employee and Employer Contributions
Often the most misunderstood part of 401(k) division is who owns what. Employee contributions (paycheck deferrals) are always fully vested. But employer contributions—especially match or profit-sharing—may be subject to a vesting schedule. If your divorce occurs before full vesting, only the vested portion is eligible for division through a QDRO.
Pay close attention to:
- Vesting percentages
- Years of service
- Break-in-service rules
