Employee and Employer Contributions
In most 401(k) plans, an employee’s contributions are fully owned by them from day one. However, employer contributions are often subject to a vesting schedule. This means that a portion of the employer match may not be available for division depending on how long the employee has worked at Rent express by berrios, Inc.. at the time of divorce.
Your QDRO must specify whether you’re dividing just the vested portion—or whether unvested benefits should be addressed if they later vest. Some former spouses are surprised when they’re cut out of a large match simply because it hadn’t vested yet at the date of divorce.
