Vesting and Employer Contributions
Many 401(k) plans, including the Red Violet, Inc.. 401(k) Plan, have vesting schedules for employer contributions. This means your spouse may have been entitled to an employer match—but only a portion of it may be vested at the time of divorce. The unvested portion is usually forfeited and cannot be assigned through a QDRO. Make sure your QDRO specifies that the division only applies to vested balances as of a particular “valuation date.”
