Vesting Schedules and Employer Contributions
Most employer contributions in a 401(k) plan are subject to vesting. That means a divorcing spouse may only be entitled to a portion of those contributions based on the length of the participant’s employment. If the participant has not met the required service years, some employer contributions may be forfeited—even if they appear on the statement.
