Many profit sharing plans include employer contributions that are not fully vested unless the employee has reached a specific number of years with the company. If your spouse is not fully vested at the time of divorce, you’ll want to make sure the QDRO only addresses the portion they’re eligible to receive. Unvested amounts typically revert to the plan—and you can’t divide what hasn’t vested yet.
