Employee vs. Employer Contributions
Most 401(k) plans—including the R.k. Miles, Inc.. Retirement Plan—feature both employee contributions and employer matches. In divorce, it’s common to divide only the marital portion, which typically includes contributions made during the marriage and any associated investment gains.
A QDRO can direct division based on a specific dollar amount or a percentage of account balances as of a certain date. Both participant and alternate payee (usually the spouse) need to be clear about what’s being split—employee-only contributions or the full balance including vested employer contributions.
