Employee and Employer Contributions
The Quality Staffing Specialists 401(k) Plan likely includes both employee contributions (funded directly from the participant’s paycheck) and employer contributions (which may have vesting requirements). A typical QDRO will divide employee contributions and vested employer contributions as of a specific date—often the date of separation, divorce, or another mutually agreed-upon date.
It’s vital to clarify in the QDRO how each type of contribution is to be split. Employer contributions that are not yet vested usually remain with the employee spouse unless stated otherwise. If you’re the alternate payee, make sure vesting and forfeiture rules are confirmed with the plan administrator.
