Types of Contributions
This particular 401(k) includes:
- Employee Contributions: These are always 100% vested and are eligible for division in a QDRO.
- Employer Contributions: These may be subject to a vesting schedule. If the employee is not fully vested, a portion of the employer contribution could be forfeited before distribution to the alternate payee.
Understanding whether the participant was fully vested at the time of divorce is critical. Otherwise, the award to the alternate payee might be less than anticipated.
