1. Employee and Employer Contributions
This plan likely includes both employee salary deferrals and employer matches or profit-sharing contributions. It’s important to specify in the QDRO what types of contributions are being divided and what method to apply—either a set dollar amount, a flat percentage, or marital coverture fraction.
Keep in mind that employer contributions are often subject to vesting. If the employee hasn’t worked for the required number of years, some of those employer funds might not be available to divide.
