Employee vs. Employer Contributions
Only contributions that were made during the marriage are typically considered marital property. With 401(k) accounts, this means:
- Employee Contributions: The portion deducted from the participant’s paycheck
- Employer Contributions: Matching or profit-sharing funds added by Pos remarketing group, Inc.. 401(k) & profit sharing plan
It’s important that your QDRO distinguishes between these sources so that only the marital portion is divided.
