Employee vs. Employer Contributions
In most 401(k) QDROs, the account is split based on marital contributions. Employee contributions are fully vested because they come directly from the participant’s paycheck. However, employer contributions might be subject to a vesting schedule. That means only a portion of those employer dollars may be available depending on the participant’s years of service with Paamco prisma, LLC.
It’s important that your QDRO reflects this. For example, if your spouse has been at the company for a short time, they may have employer contributions that aren’t yet vested—those won’t be available for division.
