Employee and Employer Contribution Division
In most cases, employee contributions are fully vested and simple to divide. However, employer contributions are often subject to vesting schedules. In the Nexagen Networks, Inc.. 401(k) Plan, the participant may not yet be entitled to the full value of the employer match at the time of divorce, especially if they’re newer to the company. You’ll want clarity on:
- What portion of employer contributions is vested
- Whether the QDRO can include unvested benefits if they become vested later
- Whether the alternate payee should share in future employer contributions based on pre-divorce service
