Dividing Employee and Employer Contributions
Both parties may assume the full 401(k) balance is divisible, but not all parts of the account belong to the participant yet. Most 401(k) plans, including ones like the Natura Life + Science 401(k) Plan, include:
- Employee Contributions: Always 100% vested and divisible.
- Employer Contributions: May be subject to a vesting schedule. Any unvested amount as of the date of division may be forfeited and not available to the alternate payee.
Timing is key. Choosing the right “valuation date” in the QDRO can affect whether certain employer contributions are included.
