Employee vs. Employer Contributions
In the N.r.f. Distributors Retirement Savings Plan, contributions can come from both the employee and N.r.f. distributors, Inc. In a divorce, the QDRO often awards the alternate payee (usually the non-employee spouse) 50% of the “marital portion,” which includes both contribution types made during the marriage. However, timing matters—only contributions made during the marriage are typically subject to division. If you want to include all funds regardless of when they were contributed, that must be clearly stated in the order.
