Employee and Employer Contributions
The Mng 2005 Inc.. 401(k) Plan likely includes both employee deferrals and matching (or discretionary) employer contributions. While employee contributions are usually 100% vested, employer contributions could be subject to a vesting schedule.
We often deal with cases where only a portion of the account is actually marital. For example, if contributions were made before the marriage or after the separation, those may not be considered community or marital property. The QDRO must clearly define the division—either by specific dollar amount, percentage, or a date-based allocation.
