Employee and Employer Contributions
The Metals Fabrication Company, Inc.. 401(k) Plan likely includes both employee deferrals and employer matching contributions. Only the portion earned during the marriage is typically subject to division—and this can include both types of contributions.
However, dividing employer contributions can be tricky if those contributions are subject to a vesting schedule. You’ll want your QDRO to clearly indicate whether the alternate payee should only receive the vested portion or any future vesting that may occur post-divorce.
