Employer and Employee Contributions
Most 401(k) plans like the Lonestar Soccer Club 401(k) Plan include both employee contributions (from paychecks) and employer matching contributions. You’ll need to decide in your divorce judgment whether each type of contribution should be split and how. For example:
- Is the alternate payee receiving 50% of the total marital account as of a specific date?
- Should only vested employer contributions be included?
- How will post-separation earnings and losses be handled?
These details must be spelled out clearly in the QDRO.
