Employee and Employer Contributions
In most 401(k) plans, including the Ll Vann Electric, Inc.. 401(k) Profit Sharing Plan, contributions come from two sources: the employee and the employer. During divorce, it’s common to split the total plan balance earned during the marriage, including both types of contributions. However, the court order must be clear about whether the division includes:
- Only employee contributions
- Both employee and employer contributions
- Gains and losses on those amounts from the division date to the distribution date
