Divorce and the Labster 401(k): Understanding Your QDRO Options

Introduction: Dividing the Labster 401(k) in Divorce

If you or your spouse has an account in the Labster 401(k), it’s important to understand how this retirement asset can—and should—be divided during a divorce. Like all 401(k) plans, the Labster 401(k) must be divided using a court-approved document called a Qualified Domestic Relations Order (QDRO).

At PeacockQDROs, we’ve seen the same issues come up again and again with 401(k) plans: questions about employee contributions, what happens to unvested employer contributions, how loans are treated, and the difference between Roth and traditional balances. We’ll explain how those factors apply specifically to the Labster 401(k), and offer actionable guidance to make sure you don’t lose time or money on your QDRO.

Plan-Specific Details for the Labster 401(k)

Here’s what we know about the Labster 401(k) plan, which is administered by Labster, Inc., a corporation in the general business industry:

  • Plan Name: Labster 401(k)
  • Sponsor Name: Labster, Inc.
  • Plan Address: 20250708164106NAL0011348482001, 2021-01-01
  • EIN: Unknown (must be obtained during the QDRO process)
  • Plan Number: Unknown (also required for filing)
  • Industry: General Business
  • Organization Type: Corporation
  • Status: Active
  • Participants, Assets, and Effective Date: Currently Unknown

The lack of published plan data at this stage makes it even more important to work with a QDRO professional who knows how to track down and confirm the necessary plan documents and administrative contacts.

Why a QDRO is Required to Divide the Labster 401(k)

Under federal law, 401(k) plans like the Labster 401(k) cannot pay benefits to anyone other than the plan participant—unless a Qualified Domestic Relations Order (QDRO) is in place. A QDRO is a court order that directs the plan to divide retirement assets as part of divorce or legal separation. Without a QDRO, you can’t access your share, and the court judgment alone isn’t enough.

It’s worth noting that even amicable divorces still require a formal QDRO when dealing with the Labster 401(k). The plan administrator cannot—and will not—act based on a divorce agreement alone.

How 401(k) Plans Like the Labster 401(k) Typically Work

401(k) retirement plans involve some unique characteristics that create questions during divorce. Here’s how the Labster 401(k), like similar defined contribution plans, is usually structured:

  • Employee Contributions: These are made pre-tax or post-tax (Roth) and belong fully to the employee.
  • Employer Contributions: Often include a matching or discretionary contribution, which may be subject to vesting.
  • Vesting Schedule: Employer contributions often vest over time. Only vested amounts can be divided in a QDRO.
  • Loans: The participant may have an outstanding 401(k) loan. These are not divisible in a QDRO.
  • Roth and Traditional Balances: Some accounts include both. A QDRO should clearly specify how each part is divided.

Each of these features matters when drafting a division order for the Labster 401(k).

Employee and Employer Contribution Divisions

In general, the marital portion of the Labster 401(k) includes deposits made—and any investment gains or losses earned—from the date of marriage through the date of separation. This includes personal deferrals (from the employee) and any vested matching or other contributions by Labster, Inc.

Be Careful with Vesting

Unlike employee deferrals, employer contributions aren’t always fully owned right away. If those employer contributions are unvested at the time of divorce, your share could be smaller than you expect. Your QDRO needs to carefully define how to assign or exclude unvested employer funds.

Loan Balances and Their Impact

If there’s an outstanding loan from the Labster 401(k), this complicates the QDRO. Loans reduce the plan value, but they don’t go away during divorce. The key considerations include:

  • Will the loan be repaid by the participant alone, or a community/debt asset?
  • Should the QDRO assign a percentage of the 401(k) that includes or excludes the loan balance?

In many cases, we recommend assigning a percentage of the total account value, including any loan, and leaving the repayment obligation with the participant who took the loan. But every case is different, and it’s important to draft language the administrator will accept.

Roth vs. Traditional Balances in the Labster 401(k)

Many 401(k) plans now offer both traditional pre-tax and post-tax Roth deferrals. These have very different tax treatments on distribution, so they should never be lumped together in QDRO language.

Your QDRO must:

  • Specify whether both Roth and traditional balances are being split
  • Indicate clearly the percentage or dollar amount from each type
  • Follow plan rules on how they maintain separate accounting internally

If this distinction isn’t addressed, the plan may push back, or worse, misapply the assigned amount. That’s avoidable with proper QDRO drafting.

What You’ll Need to Complete a QDRO for the Labster 401(k)

Even though some key plan details like the EIN and Plan Number aren’t currently available, they are required when filing a QDRO. At PeacockQDROs, we conduct our own due diligence to obtain and confirm this information before submission. You should be prepared to provide the following:

  • A copy of your divorce judgment or marital settlement agreement
  • Participant and alternate payee contact information, including Social Security Numbers
  • Date of marriage and date of separation
  • Direction on how the 401(k) should be divided—percentage, fixed dollar amount, or formula
