Employee vs. Employer Contributions
One of the first decisions is whether the QDRO will divide just the employee’s contributions or also include employer matching funds. With many corporate 401(k) plans like Kindred Motorworks 401(k) Plan, employer contributions are subject to a vesting schedule. Only vested contributions can be divided.
If only a portion of the employer contributions are vested at the time of divorce, the QDRO must clearly state whether the alternate payee receives only vested funds as of a particular date or shares in future vesting if the participant stays with the company.
