Employee vs. Employer Contributions
Many 401(k) accounts include contributions from both the employee and the employer. While employee contributions are always 100% vested, employer contributions might not be. The Instapage 401(k) Plan likely has a vesting schedule for employer matches. That means if the employee hasn’t worked a certain number of years, those employer contributions may be partially or fully forfeited. Your QDRO must clarify whether you’re dividing just the vested balance—or expecting a share of future vesting post-divorce.
