Employee and Employer Contributions
A 401(k) plan consists of both employee and potentially employer contributions. During property division, it’s important to specify whether the QDRO applies to just the participant’s own deferrals or includes the employer’s matching amounts as well.
Most spouses divide the account based on the value accrued during the marriage—typically using a set percentage (e.g., 50%) of the marital portion. But things can get complicated when employer contributions are subject to vesting.
