Employee vs. Employer Contributions
In the Imh Fabrication, Inc.. 401(k) Plan, the account usually includes contributions made by both the employee and the employer. While the employee’s contributions are 100% vested from the start, employer contributions may be subject to a vesting schedule.
During divorce proceedings, only the vested portion of the employer match is typically divisible. It’s crucial to obtain a participant statement or work directly with the plan administrator to confirm the vested balance. If your spouse isn’t fully vested, any unvested employer funds might be forfeited and not available for division.
