If you’re divorcing and your spouse has a retirement plan like the Goprime Mortgage, Inc.. 401(k) Plan, it’s common to assume that retirement benefits will automatically be divided in the divorce. But that’s not how it works. To divide a 401(k) plan—particularly one like this—you need a Qualified Domestic Relations Order, or QDRO.
Without a properly drafted and executed QDRO, you may lose your legal right to a portion of the benefits. Even if your divorce decree says you’re entitled to half, the plan’s administrator cannot legally distribute funds without an approved QDRO in place.
