401(k) plans often involve both employee and employer contributions. It’s not always as simple as splitting “the balance.” You’ll need to decide (and the QDRO must state) whether the alternate payee is receiving a flat dollar amount, a fixed percentage, or a share as of a specific date. If employer contributions are involved, consider whether they are vested or still subject to a vesting schedule.
