Employee and Employer Contributions
In most 401(k) plans, there are two main sources of funds: employee contributions (from salary deferrals) and employer contributions (like matches or profit-sharing). Your QDRO can include both, but you must specify them clearly.
Some employer contributions may be subject to a vesting schedule. It’s important to determine whether unvested amounts are eligible for division or forfeited based on the employee’s service at the time of divorce.
