Account Types: Roth vs. Traditional
This plan may include both traditional 401(k) and Roth deferral accounts. Roth accounts include after-tax contributions and may grow tax-free under certain conditions, while traditional accounts are tax-deferred. It’s important the QDRO expressly states whether the alternate payee (typically the non-employee spouse) is receiving a portion of Roth balances, traditional balances, or both. Vague orders can result in unnecessary delays—or worse, wrongful distributions.
