Employee Contributions vs. Employer Contributions
Most 401(k) plans, including the Floats and Fuel Cells 401(k) Retirement Plan, include contributions from both the employee and the employer. Employee contributions are always 100% vested because they come directly from your paycheck. However, employer contributions are often subject to a vesting schedule.
In your QDRO, it’s critical to specify whether you’re dividing the full account balance or just the vested portion. If your spouse is the participant and hasn’t reached full vesting, you may not be entitled to 100% of the employer contributions, and any unvested portion may be forfeited.
