Employee and Employer Contributions
A 401(k) plan typically includes both employee contributions (money the working spouse defers from their paycheck) and employer-matching or profit-sharing contributions. It’s critical to define in the QDRO whether both will be divided and whether the balance should be split as of a specific date (often the date of marital separation or divorce judgment).
