Employee and Employer Contributions
Employee contributions to a 401(k) plan are always 100% vested. However, employer contributions can follow a vesting schedule—meaning only some of that money may be eligible for division. In a divorce, you can only divide the vested portion. If your spouse hasn’t been with Estvold oilfield services, Inc.. 401(k) plan long enough to become fully vested, that limits the amount available for division.
