Employer Contributions and Vesting Schedules
Many 401(k) plans, including those in general business corporations like Environmental systems design, Inc.. employees 401(k) plan, include both employee contributions (which are always 100% vested) and employer contributions (which are often subject to a vesting schedule). If the employee spouse isn’t fully vested, the alternate payee is not entitled to the unvested portion.
A good QDRO will clarify what part of the employer match is being divided and account for forfeitures. If you’re trying to split a percentage of the full account balance without understanding the vesting status, you might be in for a surprise down the line.
