1. Employer Contributions and Vesting
The Dna Labs International, Inc.. 401(k) Plan is a typical 401(k), so it likely includes both employee and employer contributions. But employer contributions are often subject to a vesting schedule—meaning the employee earns rights to those contributions over time.
If your spouse isn’t fully vested, that unvested portion can’t be divided. The QDRO must distinguish between vested and non-vested funds. Also, if there’s a forfeiture clause, amounts not vested may return to the employer after divorce.
