Employee vs. Employer Contributions
401(k) plans typically include both employee (participant) and employer contributions. But not all employer contributions may be fully vested. When drafting a QDRO for the Choice Fabricators, Inc.. 401(k) Plan, it’s important to distinguish between:
- Employee Deferrals: Usually 100% vested—these are the participant’s paycheck contributions.
- Employer Matches: May be subject to a vesting schedule. Unvested portions may be forfeited if the employee separates from service too soon.
To protect your client’s interests, the QDRO should state that the alternate payee only receives the vested portion of employer contributions as of the date of division or some other appropriate cutoff date.
