Employee and Employer Contributions
A 401(k) like the Astella Retirement Plan often includes two main types of contributions:
- Employee contributions: Usually 100% vested and subject to immediate division.
- Employer contributions: May be subject to a vesting schedule. Only the vested portion at the time of divorce can be divided.
If one spouse is awarded a percentage of the plan, it’s crucial to specify if that percentage applies to only the vested portion, or the full balance including unvested funds.
