Employee and Employer Contributions
Most 401(k) plans have two types of funds: employee contributions (what the participant puts in from their paycheck) and employer contributions (matching or profit-sharing). The employee’s contributions are usually 100% vested, but employer contributions may be subject to a vesting schedule. The QDRO can only assign the vested portion to the former spouse (called the “alternate payee”).
