Employee vs. Employer Contributions
The account holder may have both pre-tax contributions and employer matches. In most divorces, courts divide the total vested balance as of a specific cutoff date (such as the date of separation or divorce). However, it’s important to:
- Determine the share attributable to the participant versus the employer
- Clarify whether the alternate payee (typically the non-employee spouse) is awarded a percentage of the total balance or just accrued marital contributions
