Employee Versus Employer Contributions
Most 401(k) accounts include both employee deferrals and employer contributions. In the case of the Access Data Network Solutions, Inc.. 401(k) & Profit Sharing Plan, you’ll need to clarify:
- Whether the division includes only employee contributions and their gains, or also includes employer matching and profit sharing contributions.
- What portion of the employer contributions are vested versus unvested as of the cutoff date.
If part of the money is unvested, it may be forfeited upon the employee’s separation from the company. That forfeiture risk affects what an alternate payee receives, so it’s crucial to time the division properly.
