Employer Contributions and Vesting Schedules
One of the most overlooked details in 401(k) QDROs is the vesting schedule. If your spouse received employer contributions under the 20250808140100nal0004474705001, it’s possible that not all of those funds are fully vested. Only vested amounts can be awarded to the alternate payee—typically you, the former spouse.
If you’re drafting a QDRO yourself or working with someone unfamiliar with the vesting structure, you may leave money on the table or include funds you’re not entitled to, which will get rejected. Always confirm with the plan administrator or include language that clearly distinguishes between vested and unvested portions as of the division date.
