Employee and Employer Contributions
401(k) contributions consist of the employee’s deferrals and, often, a matching or discretionary employer contribution. With the 20250717142015nal0000432401001, you’ll need to determine:
- What portion of both employee and employer contributions were made during the marriage
- Whether those employer contributions have fully vested
- Which party will receive the post-divorce contributions (if any)
It’s common to divide only contributions made from the date of marriage to the date of separation, but this depends on your settlement or court orders. Make sure to have clear start and end dates in your QDRO.
