Employee and Employer Contributions
401(k) plans typically include both employee deferrals and employer contributions. While employee contributions are always fully vested, employer contributions might be subject to a vesting schedule. That means only some of the employer’s deposits may be available for division in the divorce.
In your QDRO, be specific about what portion of the account is up for division. If the participant spouse isn’t fully vested, some funds may be forfeited upon separation or plan termination.
