Employee and Employer Contributions
Participants in a 401(k) typically contribute through payroll deductions. Many plans, including the American Landscape and Maintenance, Inc.. 401(k) Employee Benefit Plan, may also offer employer-matching contributions. However, employer contributions are often subject to vesting schedules. If your spouse isn’t fully vested, part of their account may not be divisible. Your QDRO must specify whether only the vested balance is divided—or include contingencies if vesting occurs after the divorce date.
