Employee vs. Employer Contributions
401(k) contributions come in two forms: what the employee puts in and what the employer matches or contributes. In many QDRO cases, the primary focus is on dividing the employee portion fairly. But some employer contributions may not yet be vested—meaning they’re not guaranteed to the employee and, therefore, not subject to division. If your order doesn’t clarify which contributions are included, it risks being rejected or enforced incorrectly.
